Advertising Policies
We strive to create a fun and safe platform, and we value treating others respectfully. To help us do so, you (“Advertiser”) must comply with these Advertising Policies of Playsee and, as applicable, our Advertising Terms, Playsee Rules, User Terms of Service, Additional Terms of Service (Business), Privacy Notice, and all rules on our Help Center (“Playsee Terms”). These Advertising Policies govern Advertiser’s access to and use of the Playsee advertising service (the “Service” or “Ad Service”). If you do not agree to these Advertising Policies, you must stop using or accessing the Service immediately. None of these Advertising Policies or other Playsee rules or terms provide any legal advice.
Each Playsee Business is responsible for ensuring that its Advertising Content (as defined in the Advertising Terms) and any other Advertiser materials and conduct comply with all Applicable Laws (as defined in the Advertising Terms). Playsee shall not be liable in any way for any Playsee Business or third-party content or conduct.
As outlined in the Advertising Terms, Playsee reserves the right to reject or remove any Advertising Content and/or suspend or terminate Advertiser’s account (“Account”) and any related Accounts without prior notice for any violation or suspected violation of these Advertising Policies, Advertising Terms, Applicable Laws, and all other applicable Playsee Terms. Playsee reserves the right to require modifications to or written substantiation for Advertising Content, and evidence of Advertiser’s licenses, authorization, or basis for making any claim in connection with Advertising Content.
By using the Service, Advertiser represents and warrants that the following requirements are met or complied with, and Advertiser is solely responsible for ensuring that the following requirements are met or complied with or complied with:
1. Applicable Laws
- Advertising Content must comply with all Applicable Laws, including without limitation the TCPA, CAN-SPAM, FTC Act (as defined respectively, in the Advertising Terms) and all applicable laws, regulations and codes of practice regarding unfair and deceptive acts and practices, intellectual property and proprietary rights, advertising, marketing, defamation, and chatbots.
- The use, reproduction, transmission, and display of Advertising Content and materials linked from Advertising Content, and any products or services made available to users through the Advertising Content, must not violate any Applicable Law(s).
- All information provided to Playsee by Advertiser, including Advertising Content or in relation to Advertiser’s goods, services, or promotions, must be lawful, truthful and not misleading. It must also be substantiated and include any required clear and conspicuous disclosures.
- Advertiser must not have side agreements with Playsee users related to Advertising Content, including for the provision of monetary or non-monetary compensation, including free or discounted products or services.
2. Advertising Content
- Advertising Content must not constitute, contain, facilitate, or promote illegal products, services, activities, or enterprises.
- Advertising Content must not be defamatory.
- Advertising Content must not be false, deceptive, or misleading.
- Advertising Content must not contain adult content, including adult or pornographic videos, publications or live shows, nudity, depictions of people in explicit or suggestive positions, activities that are overly suggestive or sexually provocative, or sexual products or services, including sex toys, sexual enhancement products, strip clubs, and escort services.
- Advertising Content promoting or branding any kind of alcoholic beverage(s) must comply with all applicable industry standards, licensing requirements and codes of practice, including any applicable restrictions and guidelines regarding the country and age of the targeted audience and restricting certain claims or content (such as associating alcohol consumption to enhanced physical performance, improved sexual, social, athletic, or professional performance, encouraging or depicting excessive or irresponsible consumption of alcohol, implying that alcohol has therapeutic, relaxing, or stimulating qualities, or depicting people under the influence of alcohol with risky or illegal activities, such as driving a vehicle or illegal drugs).
- Advertising Content for financial products and services must clearly and conspicuously disclose all terms and comply with all applicable industry standards, licensing requirements and codes of practice. Advertising Content for certain types of financial products are prohibited, including, without limitation, trading platforms, initial coin offerings (ICOs), payday loans, get-rich-quick offers, pyramid schemes, and deceptive or misleading financial offers.
- Advertising Content must not contain pharmaceutical or healthcare products or services including, without limitation, pharmacy, prescription medicine, or dietary supplements.
- Advertising Content must not contain political content of any kind, including, without limitation, regarding any candidate, political party, government official, election, referendum, ballot measure, legislation, regulation, directive, or judicial outcome.
- Advertising Content must not promote wildlife trade, products, or services derived from endangered or threatened species, including, without limitation, elephants, jaguars, and tigers.
- Advertising Content for online dating services is prohibited, including, without limitation, "adult friend finder" and “mail-order bride" types of services.
- Advertising Content must not promote gambling content, including, without limitation, lottery, gambling game apps or websites, fantasy sports, or other online prize-based games that require payment for entry. This excludes, brick-and-mortar casinos, subject to the legal requirements in the targeted countries.
- Advertising Content must not contain profanity, vulgarity, or inappropriate content.
- Advertising Content must not contain shocking or offensive topics, including, without limitation, suicide, deaths, or natural/industrial disasters.
- Advertising Content must not direct people to non-functional landing pages. This includes landing page content that interferes with a person’s ability to navigate away from the page.
- Advertising Content must not promote the sale of human body parts or fluids.
- Advertising Content must not solicit the user’s participation in lawsuits.
- Advertising Content must not contain content that asserts or implies personal attributes. This includes direct or indirect assertions or implications about a person’s race, ethnicity, religion, beliefs, age, sexual orientation or practices, gender identity, disability, physical or mental health (including medical condition), vulnerable financial status, voting status, membership in a trade union, criminal record, or name.
- Advertising Content must not promote illegal, prescription, or recreational drugs, equipment to facilitate drug use, or tobacco products, including, without limitation, cigarettes, e-cigarettes, chewing tobacco, cigars, vaping products, nicotine, paraphernalia, or related products of any kind.
- Advertising Content must not promote weapons, ammunition, explosive materials, or fireworks, or instructions for making explosives or other harmful products.
- Advertising Content must be directed to and meant to target individuals 13 years of age and older, and comply with Applicable Laws in respect of advertising to children in the countries targeted or where the Advertising Content will be accessible.
3. User Safety
- Advertising Content must not pose an unreasonable risk to user safety or experiences.
- Advertising Content must not demean, degrade, discriminate, show or incite hatred against any individual, including, without limitation, on the basis of a protected class.
- Advertising Content must not contain or encourage any violence, harassment, or bullying.
- Advertising Content must not cause or promote damage, harm, or injury to any person or property.
4.Data Usage
- You must ensure any ad data collected, received or derived from your Playsee ad (“Playsee advertising data”) is only shared with someone acting on your behalf, such as your service provider. You are responsible for ensuring your service providers protect any Playsee advertising data or any other information obtained from us to a standard that ensures at least the same level of protection as set out in these Advertising Policies, limit their use of all of that information, and keep it confidential and secure.
- Don't use Playsee advertising data, including the targeting criteria for your ad, to build, append to, edit, influence, or augment user profiles, including profiles associated with any mobile device identifier or other unique identifier that identifies any particular user, browser, computer or device.
- Don't transfer or make available any Playsee advertising data (including anonymous, aggregate, or derived data) to any ad network, ad exchange, data broker or other advertising or monetization related service.
5. Editorial Guidelines
We want to deliver ads that are engaging for users without being annoying or difficult to interact with, so we've developed editorial requirements to help keep your ads appealing to users. We've also specified technical requirements to help users and advertisers get the most out of the variety of ad formats we offer.
In order to provide a quality user experience, Google requires that all ads, extensions, and destinations meet high professional and editorial standards. We only allow ads that are clear, professional in appearance, and that lead users to content that is relevant, useful, and easy to interact with.
Examples of promotions that don't meet these editorial and professional requirements:
- overly generic ads that contain vague phrases such as "Buy products here"
- gimmicky use of words, numbers, letters, punctuation, or symbols such as “FREE”, “f-r-e-e”, and “F₹€€!!”
We want consumers to have a good experience when they click on an ad, so ad destinations must offer unique value to users and be functional, useful, and easy to navigate.
Examples of promotions that don't meet destination requirements:
- a display URL that does not accurately reflect the URL of the landing page, such as "google.com" taking users to "gmail.com"
- sites or apps that are under construction, parked domains, or are just not working
- sites that are not viewable in commonly used browsers
- sites that have disabled the browser's back button
6. Ad Review Process
Ads remain subject to our review and re-review at all times, and we may reject any ads if we consider that they violate our policies at any time. It is your responsibility to understand and comply with these Advertising Policies.
7. Misrepresentation
We want users to trust the ads on our platform, so we strive to ensure ads are clear and honest, and provide the information that users need to make informed decisions. We don’t allow ads or destinations that deceive users by excluding relevant product information or providing misleading information about products, services, or businesses.
Examples of misrepresentation: omitting or obscuring billing details such as how, what, and when users will be charged; omitting or obscuring charges associated with financial services such as interest rates, fees, and penalties; failing to display tax or license numbers, contact information, or physical address where relevant; making offers that aren't actually available; making misleading or unrealistic claims regarding weight loss or financial gain; collecting donations under false pretenses; or "phishing" or falsely purporting to be a reputable company in order to get users to part with valuable personal or financial information.
8. Circumventing Systems
We want ads across Playsee to be useful, varied, relevant, and safe for users. We don’t allow advertisers to run ads, content, or destinations that attempt to trick or circumvent our ad review processes.
Examples of abuse of the ad network: promoting content that contains malware; "cloaking" or using other techniques to hide the true destination that users are directed to; "arbitrage" or promoting destinations for the sole or primary purpose of showing ads; promoting "bridge" or "gateway" destinations that are solely designed to send users elsewhere; advertising with the sole or primary intent of gaining public social network endorsements from the user; or "gaming" or manipulating settings in an attempt to circumvent our policy review systems.
9. Intellectual Property
- Advertising Content must not infringe on the intellectual property, privacy, or other legal rights of any person or entity, including, without limitation, any copyright, trademark, or any other intellectual property or proprietary right or right of publicity or privacy.
- Advertiser must not violate users’ privacy rights under Applicable Laws.
- Advertising Content must not contain or promote counterfeit goods.
- Advertising Content must not use Playsee’s IP, including, without limitation, Playsee’s copyrights, trademarks, or any confusingly similar variations of Playsee’s trademarks.
- Advertising Content must not state or suggest that Playsee sponsors, endorses, approves of, or is affiliated with any Advertiser, Advertising Content, or any store, goods, services, or promotion of Advertiser, or any third party not so affiliated.
- Advertiser must not, nor authorize any third party to: (i) use or combine the Service with software offered under an open source license that creates obligations with respect to the Service contrary to Playsee’s Advertising Terms, or purports to grant to any third party any rights to, or immunities under, Playsee’s IP or proprietary rights in the Service; or (ii) sell, resell, rent, lease, transfer, license, sublicense, syndicate, lend or provide access to the Service without Playsee’s express prior written approval.
10. Privacy and Security
- Advertiser must maintain reasonable data privacy and security protocols, and maintain personal information in a secure environment in compliance with industry standards.
- Advertiser must ensure that any personal information obtained from users is processed and transferred in compliance with applicable data protection laws and regulations.
- Advertiser must clearly and conspicuously post a link to and comply with an easily understood privacy policy where it collects personal information. Such privacy policy, including with respect to its conspicuousness, prominence, and timing of delivery, must, at minimum, identify the nature and scope of the collection and use of information gathered, and offer users the ability to opt-out of its practices, as well as any additional elements necessary to comply with all Applicable Laws.
- If Playsee forwards to Advertiser any Advertiser-related consumer requests to access, delete, or modify personal information, such as under an applicable privacy law, Advertiser must promptly take action (within 3 business days) and respond to each consumer request pursuant to the provisions of Applicable Laws. If Playsee requests that Advertiser delete any personal information, Advertiser must delete such information within 3 business days (or if unable to delete such information, must provide all reasons for its refusal and delete the information as soon as the reasons for non-deletion have expired). In addition, within 3 business days of receiving a consumer request relating to Playsee or the Service, Advertiser shall forward to Playsee the consumer request and any related information.
- Advertiser must, no later than 48 hours of initiative any investigation of any actual or suspected data breach or breach involving personal information related to the Service, provide notice to Playsee. If such breach involves or may involve Advertiser or its Account, Advertiser must at its own expense, immediately investigate such actual or suspected breach and take reasonable steps to remedy such breach and keep Playsee apprised of such remedial efforts.
- If Advertiser provides Playsee with any personal information, Advertiser must have all necessary rights and consents to disclose the personal information, including with respect to the location transferred, and to grant the licenses granted.
- Advertiser must not use deceptive practices to get Playsee users to "follow" Advertiser’s Account or any account, profile, promotion, or claimed GeoInfo as defined in the Additional Terms of Service (Business).
- Advertising Content must not deceive users into providing personal information under false pretenses or by means prohibited by Playsee or Applicable Laws.
- Advertiser must not collect sensitive personal information through the Service, including, without limitation, information about race or ethnicity, political opinion, religious beliefs, or medical history, nor imply knowledge of or infer any sensitive personal information.
- Advertiser must not: (i) create compilations or combinations of Data (as defined in the Advertising Terms); (ii) commingle Data with other data or across advertising campaigns on platforms other than campaigns run via the Service; (iii) disclose, sell, rent, transfer, or provide access to Data to any affiliate or third party; (iv) de-aggregate Data or associate Data with any identifiable person; or (v) use Data for retargeting or profiling.
11. Unauthorized Access
- Advertiser must not provide Advertising Content that contains or connects to malware, spyware, unwanted software or any other malicious code, or knowingly breach or circumvent any program security measure.
- Advertising Content must not contain viruses, Trojan horses, worms, or other harmful programming, or spawn malicious, false or deceptive pop-ups or exit pop-ups.
- Advertiser must not, nor authorize any third party to: (i) generate automated, fraudulent or otherwise invalid impressions, inquiries, clicks, or conversions; (ii) conceal conversions for programs where they are required to be disclosed; (iii) use any automated means or form of scraping or data extraction on the Service, or to access, query, or otherwise collect Playsee advertising-related information from any property except as expressly permitted by Playsee; or (iv) interfere with the functioning of the Service.
12. Miscellaneous
- Advertising Content must meet high quality and editorial standards.
- The location shown in the video content must match the location that it is checked-in at.
- We strive to present the authenticity of the video location to users, as such, Advertising Content must not contain text covering or taking up more than 30% of the video.
- We expect our advertisers to be honest with their customers and set clear expectations about product quality, delivery times, return processes, and services provided. We reserve the right to reject an advertiser or a particular ad based on poor third-party ratings or a record of complaints.
- If Advertiser becomes involved with or named in any action relating to advertisement on Playsee, investigation, complaint, or other proceeding by or before any governmental or regulatory authority, Advertiser will immediately provide notice to Playsee of the same.
- Continued or serious violations and abuse of Playsee’s advertising platform and/or these Advertising Policies may result in the restriction and suspension of certain domains and accounts.
- We reserve the right to reject or remove any ad that negatively affects our reputation or relationship with people on Playsee or that goes against our interests. We may also remove ads, categories of ads, or advertisers that get lots of negative feedback from people on Playsee. These rules may change at any time and where required by applicable law, we will notify you in advice of such changes.
